1. About MY-INFLUENCE
MY-INFLUENCE ("the Platform", "we", "us") is an online marketplace that connects Key Opinion Leaders and Key Opinion Consumers ("Creators" or "KOL/KOC") with brands and companies ("Brands") operating in Malaysia. The Platform facilitates the discovery, negotiation, and fulfilment of content-creation campaigns through a secure escrow-based payment system.
By registering an account, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform.
2. Eligibility
- You must be at least 18 years of age to register.
- You must be a Malaysian resident, a company incorporated in Malaysia, or a foreign entity with legitimate business operations in Malaysia.
- You must provide accurate, truthful, and complete registration information.
- One person or entity may hold only one active account per role (Creator or Brand). Operating multiple accounts to circumvent platform rules is prohibited.
3. Account Registration & Security
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@myinfluencekl.com if you suspect unauthorised access.
- We reserve the right to suspend accounts with suspicious activity pending investigation.
4. Creator (KOL/KOC) Obligations
- Provide accurate and up-to-date social media handles, follower information, and profile details. Misrepresenting your reach or engagement is grounds for immediate account termination.
- Deliver content that meets the agreed campaign brief, within the deadline stated in the order.
- Do not submit content that is substantially AI-generated without disclosure, plagiarised, or otherwise fraudulent as original creative work.
- If you are unable to fulfil a confirmed order, notify the Brand and contact support before the deadline — do not simply allow the order to time out without communication.
- New accounts begin with Under Review status. Under Review Creators may have active orders but are limited until their first order is successfully completed with a rating above 4.0, after which their account is automatically upgraded to Normal status.
5. Brand Obligations
- Post accurate job descriptions, content requirements, and budgets. Misrepresenting campaign scope is prohibited.
- Once an order is created, complete payment within 48 hours. Failure to pay within this window will automatically expire the order and release the Creator's slot.
- After a Creator submits content proof, review and either approve or raise a dispute within 7 calendar days. If no action is taken within 7 days, funds are automatically released to the Creator.
- Disputes must be raised with genuine evidence. Frivolous or bad-faith disputes may result in account review and suspension.
6. Escrow & Payment Terms
- All campaign payments are held in escrow by the Platform and are not released to the Creator until the Brand approves the content or the 7-day auto-release window elapses.
- Platform fee:A 5% service fee is charged to the Brand on top of the agreed campaign amount. An additional 5% is deducted from the Creator's payout. These fees are non-refundable except in cases of Platform error.
- Auto-release: If the Brand does not review submitted content within 7 calendar days of submission, the escrow is automatically released to the Creator and the order is marked as Completed.
- Order expiry: Unpaid orders (status: AWAITING_PAYMENT) expire after 48 hours. The Creator's job slot is released and both parties are notified.
- Cashout: Creators may request withdrawal of available balance. Minimum cashout amount is RM 100. Withdrawals are processed within 3–5 business days after admin approval.
- Funds held in escrow earn no interest. Disputed funds remain in escrow until resolved by admin.
7. Dispute Resolution
- Either party may raise a dispute on an active order before the 7-day auto-release triggers.
- A dispute must include a written reason and supporting evidence (screenshots, URLs, etc.).
- Our admin team will review the evidence from both parties and make a binding decision.
- Possible outcomes: (a) full refund to Brand; (b) full payout to Creator; (c) partial settlement determined by admin.
- Admin decisions are final. We aim to resolve disputes within 5–7 business days of the dispute being raised.
8. Content & Intellectual Property
- The Creator retains ownership of all original content they create.
- Upon successful order completion, the Creator grants the Brand a non-exclusive, royalty-free licence to use the delivered content for the agreed campaign purpose and duration.
- Neither party may claim ownership over the other's pre-existing intellectual property, brand assets, or social media identity.
- MY-INFLUENCE does not claim ownership of user-generated content published on the Platform.
9. Prohibited Conduct
The following are strictly prohibited and may result in immediate account termination:
- Purchasing or artificially inflating followers, likes, or engagement metrics.
- Colluding with another party to submit false ratings or manipulate the reputation system.
- Using the Platform to facilitate illegal transactions, money laundering, or tax evasion.
- Sharing personal data of other users obtained through the Platform without their consent.
- Impersonating another person, brand, or entity.
- Attempting to circumvent platform fees by conducting off-platform transactions for campaigns originated on MY-INFLUENCE.
10. Platform Liability
- MY-INFLUENCE is a marketplace facilitator, not a party to the content-creation contract between Brand and Creator.
- We are not liable for any loss arising from user disputes beyond the value of the escrowed funds for that specific order.
- We are not liable for changes to social media platforms (follower count fluctuations, algorithm changes, account restrictions) that affect campaign outcomes.
- The Platform is provided "as is". We do not guarantee uninterrupted availability but will endeavour to maintain uptime consistent with industry standards.
11. Account Termination
- You may delete your account at any time by contacting support@myinfluencekl.com.
- We may suspend or permanently ban accounts that violate these Terms, with or without prior notice depending on the severity of the violation.
- Funds held in escrow at the time of a ban will be handled in accordance with the Dispute Resolution process (Section 7).
- Available balances in a Creator's wallet at the time of voluntary account deletion will be processed for withdrawal within 14 business days.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Malaysia.
